This document - “Terms and Conditions of use for the site www.ariencedesign.com” (hereinafter “Terms and Conditions”) sets out the conditions under which anyone may visit or access www.ariencedesign.com (hereinafter referred to as “the Site” and/or “ariencedesign.com”), and has the value of an agreement concluded between ARIENCE DESIGN SRL, in its capacity as owner and administrator of the Site, and any person who visits or accesses the Site (hereinafter referred to as “User”). Failure to accept these Terms and Conditions, or any provision thereof, shall result in the person's obligation to immediately cease accessing the Site, and to continue accessing or visiting the Site, any page therein, and any component of the Site constitutes full and unconditional acceptance of the Terms and Conditions and any provision thereof.

DEFINITIONS AND TERMS

ariencedesign.com – a Romanian company, headquartered in Târgu Jiu, Str. Unirii 83, office 1, Gorj county, Romania, having serial number in the Trade Register J18/642/2019, unique fiscal registration code 41033846.

Seller – ariencedesign.com, ARIENCE DESIGN SRL.

Buyer – any individual person over the age of 16 or a legal person who places an Order.

User – any individual or legal person who browses and collects information from this Site, has agreed to the site-specific clauses in the Terms and Conditions section.

Order – The Buyer transmits to the Seller, through the Site, its intention to purchase products and services from the Site.

Content – meaning:

  • all information on the Site that can be visited, viewed or otherwise accessed using electronic equipment;
  • the content of any message (SMS, e-mail) sent to the Buyers by the Seller by electronic means and/or any other available means of communication;
  • any information communicated by any means by an employee/collaborator of the Seller, the Buyer, according to the contact information, specified or not by them;
  • information related to the Products and/or Services and/or tariffs charged by the Seller during a certain period;
  • data regarding the Seller, or other privileged data of the Seller.

Website – the online store hosted at ariencedesign.com and its subdomains.

Goods and services – any product or service listed on the Site, including the products and services mentioned in the Order, which are to be provided by the Seller, the Buyer as a result of the concluded Contract.

Contract – represents the distance contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.

Question – a formula for addressing a User/Buyer in order to obtain information about the products or services presented on the Site.

Answer – written information that is transmitted to the User/Buyer who addressed a Question on the Site or on the Facebook page of the Seller. The answer is an explanation given by the Seller to another User/Buyer in a discussion.

Document – these Terms and Conditions.

Transaction – the collection or refund of an amount resulting from the sale of a Product and/or Service by ariencedesign.com, to the Buyer, directly or through the use of the card processing services agreed by the Seller, regardless of the method of delivery.

Specifications – all specifications and/or descriptions of the Products and Services as specified in their description.

CONTRACTUAL DOCUMENTS

By registering an Order on the Site, the Buyer agrees to the form of communication – online or e-mail – through which the Seller carries out its commercial operations.

The notification received by the Buyer after placing the online Order has the role of information and does not represent the acceptance of the order. This notification is made either electronically, via an e-mail sent automatically by the site.

The Seller reserves the right to change the quantity of goods and/or services in the Order, for justified reasons. In this case, it will notify the Buyer at the e-mail address or telephone number provided to the Seller when placing the Order and will return the amount paid.

SALES POLICY

Users/Buyers may purchase goods and services with:

  • online payment directly on the Site, in the "Shop" menu;
  • by bank transfer, based on Stripe.com.

Payment by card for orders placed on the Site is made through the payment processor www.transferwise.com. This system primarily ensures that no information about your card is transferred or stored, at any time, on the store's servers or payment processor's servers, this data being entered directly into Visa and MasterCard systems.

The prices on the Site are expressed in $ and VAT does not apply. No other costs are added to the purchase price.

For justified reasons, the Seller reserves the right to restrict the Buyer's access to place an Order, or to some of the payment/delivery methods, or to refuse to fulfil an order, if they consider that based on the Buyer's conduct or activity on Site, their actions could in any way harm the Seller.

Communication with the Seller can be done through direct interaction with them or through the addresses mentioned or in the "Contact" section of the Site. The seller is free to manage the information received without having to provide justifications.

In the case of online payments, the Seller is not/cannot be held responsible for any other additional costs incurred by the Buyer, including but not limited to currency conversion fees applied by the issuing bank of his card, if the currency of their issuance differs from RON. The responsibility for this action lies solely with the Buyer.

By completing an order, you agree to the terms and conditions set forth in this Document.

RETURN POLICY

The moment you agree to buy a product/service from Arience Design, it means that you have taken note of it and you agree and the products/services cannot be refunded.

Promotional offers are non-refundable and are subject to the terms of this Document.

The refund of the amounts collected by the Seller for products/services purchased by the Online Buyer is made only on the basis of a completed return request within 14 days from the transaction. The money will be returned to the account specified on the return form within a maximum of 90 working days from the date of registration of the return form.

DELIVERY POLICY

The delivery of the services will be made in line with the Conduit Regulation available on the website.

All the services purchased online will be downloaded directly from the website or, in case of any adjustments, the product can be delivered via e-mail.

MAJOR FORCE

None of the parties will be responsible for the failure of execution – on term and/or totally or partially – of their contract obligations, if any of these is due to a major force event. In this case, the Seller will be exonerated of returning the sums charged from the Buyer for the services purchased directly or online. The major force is the unpredictable event, which cannot be controlled by any of the parties and which cannot be avoided.

If 15 days from the date of this event happening goes by without it being stopped, the contract will be terminated, without any of the parties being able to cause any interest damage to each other.

OTHER PROVISIONS

The seller will not be liable for errors or technical inaccuracies on the Site, typos, documentation, illustrations or erroneous images. The information presented on the Site is regularly updated, improvements and/or modifications may be made at any time.
